Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between CloudTusker Technologies Private Limited, its parent companies, subsidiaries, affiliated entities, successors, assigns, contractors, vendors, service providers, infrastructure providers, officers, directors, employees and agents (collectively, “CloudTusker”, “Company”, “we”, “our” or “us”) and any individual, company, organisation, reseller, customer or end user (“Customer”, “you” or “your”) that orders, accesses, purchases, provisions, manages or uses any service provided by CloudTusker. By creating an account, submitting an order, accessing any service, paying any invoice, using any infrastructure, or otherwise interacting with the Services, you acknowledge that you have read, understood and agreed to be bound by these Terms, the Acceptable Use Policy (“AUP”), Privacy Policy, Service Level Agreements (“SLA”), Data Processing Addenda (“DPA”), and any other policies published by CloudTusker, all of which are incorporated by reference.
1. Definitions
For purposes of these Terms:
- “Account” means any customer account maintained by CloudTusker.
- “Affiliate” means any entity controlling, controlled by, or under common control with CloudTusker.
- “Content” means all data, files, software, websites, applications, databases, emails, logs, configurations, media, communications and information transmitted, stored, processed or hosted using the Services.
- “Customer Data” means all data submitted, uploaded, transmitted, stored or processed by Customer.
- “End User” means any user, visitor, customer, employee, contractor or third party authorised by Customer to access the Services.
- “Infrastructure” means servers, networks, storage systems, virtualisation platforms, software, facilities and related technology used to provide Services.
- “Services” means any product or service offered by CloudTusker, including but not limited to VPS hosting, cloud hosting, dedicated servers, colocation, managed services, shared hosting, email hosting, DNS services, software licensing, backup services, consulting services and custom solutions.
2. Eligibility
You represent and warrant that: you are at least eighteen (18) years of age; you possess legal capacity to enter into binding agreements; you are not subject to sanctions, trade restrictions or prohibitions under applicable laws; your use of the Services will comply with all applicable laws and regulations; and all information provided to CloudTusker is complete, accurate and current. CloudTusker reserves the right to reject, suspend or terminate any account at its sole discretion if eligibility requirements are not satisfied.
3. Account Registration and Verification
CloudTusker may require identity verification before or after activation of Services. Verification documents may include government-issued identification, passport, driver’s licence, national identity card, corporate registration documents, tax registration documents, proof of address, utility bills, bank verification documents and beneficial ownership information. Failure to provide requested information may result in order cancellation, suspension or termination. Customer authorises CloudTusker to perform fraud prevention, identity verification, sanctions screening and risk assessment activities. CloudTusker may refuse service where fraud, abuse, identity concealment, payment risk or regulatory concerns are identified.
4. Service Provision
CloudTusker may offer Virtual Private Servers (VPS), Dedicated Servers, Bare Metal Servers, Shared Hosting, Reseller Hosting, Email Hosting, Managed Services, Cloud Infrastructure, Storage Services, Backup Services, DNS Services, Domain Registration Services, Colocation Services, Software Licensing, Professional Services and Consulting Services. Service specifications are published on CloudTusker’s website and may be updated from time to time. CloudTusker reserves the right to improve, replace, modify, migrate, redesign or discontinue any Service at any time. No feature, configuration, hardware platform, software version or infrastructure design is guaranteed to remain permanently available.
5. Acceptable Use
Customer shall comply with the Acceptable Use Policy at all times. Customer is responsible for the actions of End Users, employees, contractors, customers, resellers and affiliates. Any violation by an End User shall be deemed a violation by the Customer. CloudTusker may take immediate action to protect its infrastructure, customers, networks and reputation.
6. Billing and Payment
All Services are provided on a prepaid basis unless otherwise agreed in writing. Invoices must be paid on or before the due date. Failure to pay invoices may result in suspension, service restriction, removal of IP connectivity, service termination or collection actions. CloudTusker may assess reasonable late fees where permitted by law. Customer remains responsible for all charges incurred on the Account regardless of actual usage. CloudTusker may require security deposits, advance payments or enhanced verification for higher-risk accounts.
7. Taxes
Unless expressly stated otherwise, all pricing excludes GST, VAT, sales taxes, duties, withholding taxes and regulatory charges. Customer shall be solely responsible for payment of all applicable taxes.
8. Refund Policy
Except where required by applicable law, all payments are non-refundable. The following are generally non-refundable: domain registrations, domain renewals, SSL certificates, dedicated servers, setup fees, professional services, managed services, software licences, cryptocurrency payments and custom development work. Approval of any refund shall remain at CloudTusker’s sole discretion.
9. Suspension and Service Restrictions
CloudTusker may suspend any Service immediately without notice where payment is overdue; abuse is detected; security risks exist; malware activity is identified; network attacks are detected; fraud is suspected; legal obligations require action; regulatory authorities request action; or infrastructure stability is threatened. CloudTusker shall have no liability arising from such suspension.
10. Customer Data
Customer retains ownership of Customer Data. Customer grants CloudTusker a worldwide, non-exclusive licence to store, process, replicate, backup, transmit, analyse (for operational purposes), protect Customer Data and maintain Service functionality. CloudTusker obtains no ownership interest in Customer Data.
11. Backup Responsibility
Unless expressly stated otherwise in a separate written agreement, Customer remains solely responsible for maintaining complete, current and independently verifiable backups of all Customer Data. Backup services provided by CloudTusker are provided on a commercially reasonable basis and are not guaranteed disaster recovery solutions. CloudTusker shall not be liable for data loss, corruption, deletion or unavailability.
12. Security Responsibilities
Customer shall use strong passwords; enable multi-factor authentication where available; maintain updated software; patch vulnerabilities promptly; restrict unauthorised access; monitor systems for abuse; and secure APIs and credentials. CloudTusker operates under a shared responsibility model. Customer remains responsible for security of applications, operating systems and hosted content.
13. IP Addresses and Network Resources
All IP addresses allocated by CloudTusker remain the property of CloudTusker or its upstream providers. Customer receives only a revocable right to use assigned addresses during active service periods. CloudTusker may reclaim, renumber or reassign IP addresses where operationally necessary. Customer shall not acquire ownership rights in any assigned network resource.
14. Domain Services
Domain registrations are governed by registry policies, registrar agreements, ICANN policies and applicable regulations. CloudTusker does not guarantee successful registration, renewal or transfer of any domain name. Customer remains responsible for monitoring domain expiration dates.
15. Intellectual Property
CloudTusker retains all rights, title and interest in its software, documentation, trademarks, branding, infrastructure designs, websites, platforms and APIs. No ownership rights are transferred to Customer.
16. Confidentiality
Each party shall protect confidential information disclosed by the other party using reasonable safeguards. Confidential information shall not include information that is publicly available, was lawfully obtained from a third party, was independently developed, or must be disclosed by law.
17. Monitoring and Abuse Prevention
CloudTusker may monitor infrastructure, networks and services for security threats, abuse activity, malware, fraud, operational issues and regulatory compliance. Monitoring shall be conducted in accordance with applicable laws and the Privacy Policy.
18. Compliance With Laws
Customer shall comply with all applicable laws including the Information Technology Act, 2000; the Digital Personal Data Protection Act, 2023; CERT-In Directions; copyright laws; trademark laws; export control laws; anti-money laundering regulations; and sanctions regulations.
19. Third-Party Services
CloudTusker may utilise third-party providers including datacentres, cloud providers, transit providers, DNS operators, payment processors and security vendors. Availability of Services may depend upon such third parties. CloudTusker shall not be liable for failures attributable to third-party providers.
20. Disclaimer of Warranties
SERVICES ARE PROVIDED ON AN “AS IS”, “AS AVAILABLE” AND “WITH ALL FAULTS” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLOUDTUSKER DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY; FITNESS FOR A PARTICULAR PURPOSE; NON-INFRINGEMENT; AVAILABILITY; ACCURACY; SECURITY; AND RELIABILITY. CLOUDTUSKER DOES NOT WARRANT THAT SERVICES WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.
21. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLOUDTUSKER SHALL NOT BE LIABLE FOR LOSS OF PROFITS; LOSS OF REVENUE; LOSS OF BUSINESS; LOSS OF GOODWILL; DATA LOSS; BUSINESS INTERRUPTION; OR CONSEQUENTIAL, INDIRECT, SPECIAL OR PUNITIVE DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY CUSTOMER DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
22. Indemnification
Customer shall defend, indemnify and hold harmless CloudTusker from all claims, damages, liabilities, losses, penalties, costs and expenses arising from Customer Data; Customer activities; Customer services; End Users; violations of law; intellectual property claims; privacy violations; and security incidents caused by Customer.
23. Force Majeure
CloudTusker shall not be liable for failure or delay resulting from events beyond reasonable control, including natural disasters, pandemics, government actions, civil unrest, terrorism, fibre cuts, internet outages, power failures, cyber warfare and supply chain disruptions.
24. Governing Law
These Terms shall be governed by and construed under the laws of India. The courts located in Bengaluru, Karnataka shall possess exclusive jurisdiction over disputes arising under these Terms.
25. Amendments
CloudTusker may modify these Terms at any time. Updated versions shall become effective upon publication unless otherwise stated. Continued use of Services constitutes acceptance of revised Terms.
26. Entire Agreement
These Terms, together with the Privacy Policy, Acceptable Use Policy, Service Level Agreements and any executed agreements between the parties, constitute the entire agreement between Customer and CloudTusker.
27. Severability
If any provision is held unenforceable, the remaining provisions shall remain in full force and effect.
28. Survival
Provisions relating to payment obligations, confidentiality, intellectual property, indemnification, liability limitations, dispute resolution and data retention shall survive termination.

Billing, Payments & Refunds
Summary of Terms of Service §6–8
Billing & Payment
All Services are prepaid unless otherwise agreed in writing, and invoices must be paid on or before the due date. Prices on longer terms (quarterly, annual or 3-year) are discounted and billed upfront for the full term. We accept major cards, UPI and net-banking, billed in INR (₹) or USD ($). Non-payment may result in suspension, service restriction, removal of IP connectivity, termination or collection actions, and reasonable late fees may apply where permitted by law.
Taxes
Unless expressly stated otherwise, pricing excludes GST, VAT, sales taxes, duties, withholding taxes and regulatory charges. You are solely responsible for payment of all applicable taxes.
Refunds
Except where required by applicable law, all payments are non-refundable. Domain registrations & renewals, SSL certificates, dedicated servers, setup fees, professional & managed services, software licences, cryptocurrency payments and custom development work are generally non-refundable. Approval of any refund remains at CloudTusker’s sole discretion.
Acceptable Use Policy (AUP)
Effective Date: 15 June 2026
This Acceptable Use Policy (“AUP”) governs the use of all products, services, infrastructure, networks, systems, websites, applications, software and resources provided by CloudTusker Technologies Private Limited. This AUP forms an integral part of the CloudTusker Terms of Service and applies to all customers, account holders, resellers, affiliates, end users, contractors, employees and any party using or benefiting from the Services. CloudTusker reserves the right to investigate, restrict, suspend or terminate any Service that violates this AUP or presents a risk to CloudTusker, its customers, infrastructure providers, upstream carriers, business partners or the wider internet community.
1. Purpose
The purpose of this AUP is to protect infrastructure stability; protect customers and end users; maintain network integrity; prevent abuse; ensure legal compliance; promote responsible use of internet resources; and preserve CloudTusker’s reputation and relationships with service providers. Violation may result in warnings, service restrictions, suspension, termination, data preservation, legal action, reporting to authorities, or any combination thereof.
2. General Obligations
Customers shall use Services responsibly, lawfully and in a manner that does not damage infrastructure, interfere with network operations, harm third parties, violate laws or intellectual property rights, disrupt other customers, or create excessive operational risk. Customers are responsible for all activities originating from their account, services, infrastructure, assigned IP addresses, customers and end users, and must take reasonable steps to prevent abuse and respond promptly to abuse notifications.
3. Illegal Activities
Services may not be used for any activity prohibited by applicable law, including fraud, identity theft, forgery, money laundering, terrorist financing, human trafficking, illegal drug distribution, contraband sales, financial scams, securities/investment/cryptocurrency fraud, tax evasion schemes, unlicensed gambling, illegal surveillance, and unauthorised interception of communications. CloudTusker may immediately suspend Services where unlawful activity is suspected.
4. Network Abuse
Customers may not engage in activities that disrupt, impair or compromise networks or systems, including DDoS/DoS, reflection & amplification attacks, protocol abuse, application-layer attacks, network flooding, traffic manipulation, routing/BGP/DNS abuse, network interference and service disruption. Customers may not knowingly host or facilitate infrastructure used to conduct such activities.
5. Unauthorised Access
Customers may not gain unauthorised access to systems, circumvent authentication, bypass security controls, escalate privileges without authorisation, access confidential information without permission, interfere with access controls, or exploit software vulnerabilities without authorisation.
6. Reconnaissance and Scanning
Port scanning, vulnerability scanning, network reconnaissance, enumeration, fingerprinting, banner collection, security probing and discovery of exposed services are prohibited unless explicitly authorised by the target system owner. CloudTusker may require documentary evidence of authorisation.
7. Malware and Malicious Software
Customers may not host, distribute, develop, facilitate, control or operate malware, viruses, worms, trojans, rootkits, spyware, adware, botnets, ransomware, loaders, droppers, keyloggers, credential stealers, remote access trojans, malicious scripts or malicious payload delivery infrastructure. CloudTusker reserves the right to immediately disable affected services.
8. Botnets and Command-and-Control Infrastructure
Services may not be used to operate botnets, control compromised devices, coordinate malicious activity, manage infected systems, distribute attack instructions or control malware infrastructure. Evidence of botnet activity may result in immediate termination.
9. Spam and Messaging Abuse
Customers may not send, transmit, relay or facilitate unsolicited bulk email, spam, purchased-list or harvested-recipient campaigns, email bombing, mass unsolicited messaging, SMS spam or messaging platform abuse, and must comply with applicable anti-spam laws and industry best practices.
10. Phishing and Deceptive Practices
Services may not be used for phishing, credential harvesting, identity or brand impersonation, business email compromise, fake login portals, fraudulent websites, social engineering campaigns or deceptive communications. Any evidence of phishing activity may result in immediate termination.
11. Fraudulent Content
Customers may not host or operate scam websites, fraudulent investment schemes, Ponzi or pyramid schemes, advance-fee fraud operations, fake online stores, counterfeit product marketplaces or cryptocurrency scams.
12. Child Safety
CloudTusker maintains a zero-tolerance policy regarding child exploitation. Services may not be used to host, transmit, distribute, store or facilitate child sexual abuse material (CSAM), child exploitation or trafficking content, grooming activities, or any material prohibited under child protection laws. CloudTusker may immediately suspend Services, preserve evidence, report incidents and cooperate with law enforcement, with no prior notice required.
13. Violent Extremism and Terrorism
Services may not be used for terrorist recruitment, propaganda, financing, communications, extremist training material or promotion of violent extremist organisations. CloudTusker reserves the right to immediately terminate such Services.
14. Intellectual Property Violations
Customers may not infringe copyrights, trademarks or patents; circumvent licensing systems; distribute pirated software; operate piracy services; or host infringing content. CloudTusker may remove content or suspend Services upon receipt of valid complaints.
15. Copyright Complaints
CloudTusker may investigate copyright complaints and require customers to remove content, respond to notices, demonstrate rights ownership or cease infringing activity. Repeated infringement may result in account termination.
16. Resource Abuse
Customers shall not consume excessive resources in a manner that negatively impacts infrastructure or other customers, including excessive CPU utilisation, memory consumption, disk I/O, storage utilisation, network bandwidth usage or packet generation rates. CloudTusker may apply technical limitations where necessary.
17. Shared Hosting Restrictions
On shared hosting platforms, customers may not run persistent daemons, conduct cryptocurrency mining, operate resource-intensive applications, conduct large-scale automation, or perform activities inconsistent with shared-hosting environments.
18. Cryptocurrency Activities
Unless expressly permitted, customers may not use Services for cryptocurrency mining, mining pools, or resource-intensive blockchain processing. Permitted cryptocurrency activities may remain subject to resource restrictions, and CloudTusker reserves discretion to restrict blockchain-related workloads that negatively affect infrastructure.
19. Proxy, VPN and Relay Services
Proxy, VPN and relay services may be permitted provided they comply with law, do not facilitate abuse, maintain appropriate abuse handling procedures and respond to complaints promptly. CloudTusker may restrict such services where abuse levels become excessive.
20. Open Relays
Customers may not operate open mail relays, open proxies, open DNS resolvers or open forwarding services where such services may be abused by third parties.
21. Security Requirements
Customers shall maintain current software, apply security updates, secure credentials, use strong authentication, monitor systems for abuse and respond to security incidents promptly. Compromised systems must be remediated immediately.
22. Abuse Reporting
CloudTusker may receive abuse reports from customers, infrastructure providers, network operators, security organisations, law enforcement and government authorities. Customers shall cooperate in resolving abuse complaints; failure to respond may result in suspension.
23. Investigation Rights
CloudTusker may investigate suspected violations of this AUP, the Terms of Service, applicable laws or industry standards, including log review, traffic analysis, security analysis, content review where legally permissible, and risk assessment. CloudTusker is not obligated to disclose investigative methods.
24. Emergency Actions
CloudTusker may immediately suspend Services, disconnect systems, block network traffic, null-route IP addresses, remove content or restrict functionality where necessary to protect infrastructure, customers, third parties or network stability. No prior notice shall be required.
25. Law Enforcement Cooperation
CloudTusker may preserve, disclose or provide information where required by courts, regulatory authorities, law enforcement agencies, CERT-In or government authorities, and may comply with lawful requests without prior notice where permitted or required by law.
26. Data Preservation
CloudTusker may preserve logs, account information, communications and other relevant information where abuse is suspected, litigation is anticipated, regulatory requests are received, or legal obligations require preservation.
27. Reseller Responsibilities
Resellers remain responsible for the conduct of their customers and end users, and shall maintain abuse contacts, investigate complaints, enforce acceptable use standards and cooperate with CloudTusker investigations. Abuse by reseller customers may be attributed to the reseller.
28. Repeat Violations
Repeated violations may result in warnings, service restrictions, suspension, termination or refusal of future service. CloudTusker reserves sole discretion regarding enforcement actions.
29. Appeals
Customers may submit appeals through CloudTusker support channels. Submission of an appeal does not guarantee reinstatement, and CloudTusker’s determination regarding reinstatement shall be final.
30. No Obligation to Monitor
CloudTusker is not obligated to proactively monitor all customer activity. Failure to detect or enforce a violation shall not constitute a waiver of CloudTusker’s rights.
31. Reservation of Rights
CloudTusker reserves the right to take any action reasonably necessary to protect infrastructure, customers and third parties, comply with legal obligations and preserve service stability.
32. Modifications
CloudTusker may modify this AUP at any time. Updated versions become effective upon publication unless otherwise stated. Continued use of Services constitutes acceptance of revised versions.

Privacy Policy

CloudTusker Technologies Private Limited respects the privacy of our customers, users, website visitors, partners, vendors and other individuals whose personal information we process. This Privacy Policy describes how CloudTusker collects, uses, stores, discloses, transfers and protects personal information in connection with our websites, platforms, applications, APIs, products, infrastructure and services. By using our Services, you acknowledge that your information may be processed as described in this Privacy Policy.
1. Scope
This Privacy Policy applies to CloudTusker websites, customer portals, billing systems, support systems, cloud infrastructure platforms, hosting/VPS/dedicated/colocation/email/domain/managed/professional services, and related applications and APIs. It does not apply to information processed solely on behalf of customers acting as independent data controllers.
2. Definitions
“Personal Data” means information relating to an identified or identifiable natural person. “Processing” means any operation performed on Personal Data including collection, recording, storage, use, disclosure, deletion or destruction. “Customer Data” means information uploaded, stored, transmitted or processed by customers using the Services. “Account Data” means information provided when registering or managing an account.
3. Information We Collect
Account Information: full name, business name, registered company details, email, telephone, billing & physical address, account credentials and preferences.
Identity Verification: where required, government ID, passport, national identity card, driving licence, company registration, tax registration, beneficial ownership and proof of address.
Billing & Payment: billing records, payment identifiers, invoice records, tax information, transaction history and fraud prevention information. CloudTusker generally does not store complete payment card information where processing is performed by third-party payment processors.
Technical: IP addresses, device identifiers, browser & OS information, user-agent strings, session identifiers, login timestamps, network information and platform usage data.
Service Usage: resource utilisation, server performance metrics, service configurations, API activity, authentication activity, security events, audit logs and support interactions.
Communications: support tickets, emails, chat conversations, telephone calls, abuse reports, legal requests and customer feedback.
Cookies & Similar Technologies: cookies, session identifiers, local storage, authentication tokens, security tokens and analytics technologies.
4. Lawful Basis for Processing
Where applicable, CloudTusker processes Personal Data based on performance of a contract, compliance with legal obligations, legitimate business interests, consent, protection of rights/property/security, fraud prevention, and network and information security.
5. Purposes of Processing
We may process Personal Data to provide Services; provision infrastructure; authenticate users; manage accounts; process payments; deliver support; detect fraud; prevent abuse; maintain security; monitor infrastructure health; investigate incidents; comply with legal obligations; improve products and services; conduct internal analytics; and enforce contractual rights.
6. Security Monitoring
CloudTusker may process information for security purposes including malware detection, abuse detection, intrusion detection, threat intelligence, network security monitoring, incident investigation and vulnerability management. Such processing is necessary to protect customers, infrastructure and the public internet.
7. Customer Content
Customers retain ownership of Customer Data. CloudTusker does not claim ownership of customer websites, databases, emails, applications or hosted content, and may access Customer Data only when reasonably necessary to provide Services, troubleshoot, respond to support requests, maintain security, comply with legal obligations or protect infrastructure.
8. Data Sharing
CloudTusker may disclose information to infrastructure providers (datacentre operators, colocation/network/transit providers, cloud infrastructure providers); payment providers (payment processors, financial institutions, fraud prevention providers); service providers (monitoring, security, software, communication vendors); professional advisors (auditors, accountants, legal advisors, compliance consultants); corporate affiliates; and, where legally required, government authorities (courts, regulatory authorities, law enforcement, CERT-In, tax authorities, government departments).
9. International Data Transfers
CloudTusker operates infrastructure and engages service providers in multiple jurisdictions. Personal Data may be transferred to and processed in countries other than the data subject’s country of residence. Where appropriate, CloudTusker implements reasonable safeguards to protect transferred information.
10. Data Retention
CloudTusker retains information for as long as reasonably necessary to provide Services, fulfil contractual obligations, comply with legal requirements, resolve disputes, enforce agreements, prevent fraud and investigate abuse. Retention periods may vary, and certain information may be retained following account closure where required by law or legitimate business necessity.
11. Security Measures
CloudTusker maintains administrative, technical and organisational safeguards which may include encryption, access & authentication controls, security monitoring, logging systems, backup systems, employee access restrictions, vendor risk management and physical security measures. No system or transmission method can be guaranteed to be completely secure.
12. Customer Responsibilities
Customers remain responsible for securing applications and operating systems, managing credentials, protecting encryption keys, maintaining backups and managing access permissions. CloudTusker operates under a shared responsibility model.
13. Children’s Privacy
Services are not directed toward individuals under eighteen (18) years of age. CloudTusker does not knowingly collect Personal Data from children, and any such information identified may be deleted without notice.
14. Your Rights
Subject to applicable law, individuals may have access, correction, erasure, restriction, objection, data portability and withdrawal-of-consent rights. CloudTusker may require identity verification before responding to requests, and certain rights may be limited where legal obligations require continued processing.
15. Marketing Communications
CloudTusker may send service announcements, billing notices, security notifications, product updates and promotional communications. Recipients may opt out of promotional communications where legally required; operational and security communications may continue regardless of marketing preferences.
16. Cookies Policy
